This is quite a complicated and worrying problem for me, and I am wondering if anybody has ever been in the same situation. I have been charged with a criminal offence, and there is the strong possibility I might get a jail sentence. This obviously means I am going to lose my job as well.
I have a partner who doesnt live with me, but is due to move in with me in 6 weeks time, and is sticking by me as are all my friends and family. The big issue for me is finance and how she is going to cope if I get a jail sentence, so in the short term I got a bank loan of £3k which I want her to use in the short term to supplement any money she has coming in.
The downside is although I work, I am confident I will be entitled to legal aid, but I now have a bank balance of £3k+ so when the Legal Aid board see that they might turn down my request. I dont know whether I could put the money into her bank account and not my own. I specifically got the loan so she could in the short term still run the house, so I dont know whether to move the money into my fathers bank account, my partners bank account or some other alternative.
I just cant afford to pay full lawyer costs, but I am scared that if I don't move this money out of my bank account quickly the vast majority might get eaten up to pay for my solicitor. When I first got charged, I obviously didn't have a large amount in my bank, so it looked like Legal aid would be granted without a problem.
Although getting the bank loan, will help us financially, it has created another big problem with me from the solicitor point of view. I would be grateful for any advice.
